Duration and cancellation modalities
1. Scope of Application
These General Terms and Conditions (T&C) apply to all contracts between the Horizont Beteiligungs GmbH (hereinafter "we") and our customers.
They apply to both consumers (§ 13 BGB) and entrepreneurs (§ 14 BGB). The version of these T&C valid at the time of conclusion of the contract is decisive.
2. Contract Formation
2.1 Product Representations
Product images and descriptions are non-binding and do not constitute an offer, but an invitation to submit an offer (invitatio ad offerendum).
2.2 Contract Formation with Consumers (B2C)
- Offer: By clicking "order with payment obligation" you submit a binding offer.
- Order Confirmation: The automatically sent order confirmation only confirms receipt of the order and does not yet constitute acceptance.
- Acceptance: The contract is concluded when we explicitly accept your order by email or dispatch the goods.
2.3 Contract Formation with Entrepreneurs (B2B)
By placing your order you submit a binding offer which you are bound to for 14 days.
Acceptance occurs through: written order confirmation by email, dispatch of goods or performance of services.
3. Service Description / Location Services
3.1 How Location Works
The accuracy of location data depends on various factors:
- GPS signal quality
- Mobile network coverage
- structural conditions (e.g. buildings, tunnels)
- Weather influences
5. Contract Term & Cancellation
The minimum contract term is 3 months.
After the minimum contract term, the contract can be terminated with one month's notice to the end of the month.
7. Prices & Payment Terms
All prices include statutory value added tax.
7.1 Billing
The monthly service fees are billed semi-annually in advance (6 months).
8. Right of Withdrawal for Consumers
Consumers have a statutory right of withdrawal of 14 days (§§ 312g, 355 BGB).
9. Warranty
For Consumers (B2C)
- 24 months statutory warranty
- 12 months reversal of burden of proof (§ 477 BGB)
For Entrepreneurs (B2B)
- 12 months warranty
- Inspection and notification obligation pursuant to § 377 HGB
